These Terms of Service ("Terms") govern your access to and use of ClientScale, operated by Compact Services LLP, a limited liability partnership registered under the Limited Liability Partnership Act, 2008 of India with its principal office at H. No 396, Nonodi, Dontalav, Virar, Palghar, Maharashtra, 401301, India ("Company", "we", "our", "us"). By using the service, you agree to these Terms.
1. Eligibility and Account Access
You must be legally able to enter into binding contracts and provide accurate registration information. You are responsible for maintaining account credentials and for activity under your account.
2. Service Scope
ClientScale provides lead management, communication workflows, reporting, and related features. We may improve, modify, or discontinue features as part of ongoing product development.
3. Acceptable Use
You agree not to misuse the service, violate applicable laws, send unlawful communications, attempt unauthorized access, or interfere with system security or availability. You will comply with all applicable rules of Meta Platforms, Inc., including the WhatsApp Business Messaging Policy and WhatsApp Business Solution Terms.
4. Data and Third-Party Services
The platform integrates with third-party providers including authentication, analytics, error monitoring, communication APIs, payment providers, and cloud storage services. Your use of those integrations may also be subject to third-party terms. Card, UPI, NetBanking, and wallet payments are processed by Razorpay Software Private Limited.
5. SMS Messaging Terms
Messages Sent Directly by ClientScale
When you explicitly opt in to receive SMS messages directly from ClientScale, you may receive customer care responses, enquiry follow-ups, appointment confirmations and reminders, service-related updates, and, where separately authorized, promotional messages.
Message frequency varies based on your interactions. Message and data rates may apply. Consent to receive SMS messages is not a condition of purchasing any product or service.
You may opt out at any time by replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT. After opting out, you may receive a final confirmation message. Reply HELP for assistance or contact compactservicesllp@gmail.com.
Wireless carriers are not liable for delayed or undelivered messages.
Messages Sent by Businesses Using ClientScale
Businesses using ClientScale are responsible for obtaining and documenting legally sufficient consent before sending SMS messages to their contacts. Each business is responsible for its message content, messaging program, consent procedures, opt-out handling, and compliance with applicable laws, carrier requirements, and telecommunications-provider policies.
Providing a mobile phone number to ClientScale or to a business using ClientScale does not, by itself, constitute consent to receive recurring automated or promotional SMS messages. Consent must be collected through an explicit and voluntary opt-in process.
Where required, promotional or marketing consent must be collected separately from consent for informational, transactional, appointment-related, or customer-care messages.
ClientScale may suspend messaging access when a business does not maintain adequate consent records, fails to honor an opt-out request, or otherwise violates applicable messaging requirements.
6. Fees and Subscriptions
Paid features may require an active subscription. Fees, billing cycles, and cancellation terms are presented at purchase and are quoted in INR. Applicable Goods and Services Tax (GST) will be added at the prevailing rate. Unless required by law, payments are non-refundable.
7. Intellectual Property
The service, including software, branding, and content created by the Company, is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the service according to these Terms.
8. Disclaimer and Limitation of Liability
The service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties and limit liability for indirect, incidental, special, consequential, or punitive damages.
9. Termination
We may suspend or terminate access where necessary to protect the service, enforce these Terms, or comply with law. You may stop using the service at any time.
10. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes will be subject to the exclusive jurisdiction of the courts located at the registered office of Compact Services LLP.
